DMCA Policy
1. Overview
EliteStream IPTV respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and equivalent international copyright laws. We respond promptly to valid notices of alleged copyright infringement.
This DMCA Policy explains how copyright owners may submit a takedown notice, how affected parties may submit a counter-notice, and how EliteStream handles repeat infringers. If you believe that content accessible through our Service infringes your copyright, please follow the procedure below.
Please note that EliteStream IPTV acts as a service provider and does not own or control the content delivered through the live channel streams. Content is originated and broadcast by third-party broadcasters and channel operators.
2. Safe Harbor Statement
EliteStream IPTV seeks to qualify for the safe harbor protections provided under Section 512 of the DMCA. In accordance with these provisions, we:
- Do not have actual knowledge of infringing material on our network in the absence of a proper DMCA notice.
- Act expeditiously to disable access to or remove allegedly infringing material upon receiving a compliant takedown notice.
- Do not financially benefit directly from infringing activity where we have the right and ability to control such activity.
- Have designated a copyright agent to receive infringement notifications (see Section 9).
- Maintain and enforce a policy of terminating accounts of repeat copyright infringers.
3. Submitting a Takedown Notice
If you are a copyright owner (or authorized to act on behalf of one) and believe that material accessible through our Service infringes your copyright, you may submit a takedown notice to our Designated Copyright Agent. Your notice must be in writing and must include all elements specified in Section 4 below.
Upon receiving a valid, complete DMCA takedown notice, we will:
- Promptly investigate the claim and assess whether the material appears to infringe the copyright identified.
- Disable access to or remove the allegedly infringing material if the notice is legally sufficient.
- Notify the subscriber or user responsible for the allegedly infringing material, unless notification would be legally prohibited.
- Provide the subscriber with a copy of the notice so they may submit a counter-notice if they believe the material was removed in error.
We aim to process valid notices within 5–10 business days of receipt.
4. Required Elements of a Takedown Notice
To be legally effective under the DMCA, your takedown notice must include ALL of the following elements (17 U.S.C. § 512(c)(3)):
- Identification of the copyrighted work: A description of the copyrighted work you believe has been infringed. If multiple works are covered in a single notice, a representative list is acceptable.
- Identification of the infringing material: A specific description of the material you believe is infringing and where it can be found on our Service (URL, stream name, channel identifier, or other sufficiently detailed information to allow us to locate the material).
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or applicable law.
- Accuracy statement: A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or authorized to act on behalf of the owner.
- Signature: Your physical or electronic signature.
Incomplete notices may not be acted upon. We reserve the right to request additional information to process your notice.

5. Submitting a Counter-Notice
If you believe that material was removed or disabled in error — for example, because you are the rights holder, you have a license to use the content, or the material is protected by fair use or another exception — you may submit a counter-notice to our Designated Copyright Agent.
Upon receiving a valid counter-notice, we will:
- Forward a copy of the counter-notice to the original complainant.
- Inform the complainant that we will restore the disabled material within 10–14 business days unless the complainant files a court action to restrain the restoration.
- Restore access to the material after the waiting period if no court action is filed by the complainant.
Important: By submitting a counter-notice, you consent to the jurisdiction of the federal courts for your district and accept that the complainant may forward your contact information to the original claimant to enable them to file a lawsuit against you.
6. Required Elements of a Counter-Notice
To be legally effective, your counter-notice must include ALL of the following elements (17 U.S.C. § 512(g)(3)):
- Identification of the removed material: A description of the material that was removed or disabled and the location at which it appeared before removal (URL, channel name, or other identifier).
- Good faith statement: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or any judicial district if your address is outside the United States), and that you will accept service of process from the complainant or their agent.
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Signature: Your physical or electronic signature.
7. Repeat Infringer Policy
In accordance with the DMCA and our commitment to protecting intellectual property, EliteStream IPTV maintains a policy of terminating — in appropriate circumstances — the accounts of subscribers and users who are repeat copyright infringers.
An account may be flagged as a repeat infringer if:
- Multiple valid DMCA takedown notices have been received naming the same account.
- The account has been found to be distributing, retransmitting, or facilitating the unauthorized sharing of copyrighted content.
- The account holder has admitted to or been adjudicated as infringing copyrights.
Accounts terminated under this policy are not eligible for a refund. We track infringement complaints and maintain records in compliance with applicable laws.
8. False Claims & Misrepresentation
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for any damages — including costs and attorneys’ fees — incurred by alleged infringers, copyright owners, or service providers who are injured by such misrepresentation.
Before submitting a takedown notice or counter-notice, please ensure that your claims are accurate and made in good faith. We reserve the right to report abusive or fraudulent notices to relevant authorities.
